When can I get compensation due to strike?

The European Court of Justice has ruled that if a flight is cancelled or delayed by at least 3 hours due to strike by airline employees, you can be entitled to EUR 250/400/600 in compensation.

When can you claim compensation?

  • You had a flight cancellation by an airline staff strike
  • Pilot strike
  • Cabin crew strike
  • Airline engineers’ strike
  • Your flight was either delayed by 3 hours or more, or was cancelled less than 14 days before it was due to depart.
  • You can upload a valid booking confirmation.
  • The disruption occurred within the last 3 years.
  • If you took an alternative flight, your new arrival time was significantly later than the original arrival time.
  • Your boarding was denied and you have a report about it.

Under EC Regulation 261/2004 airlines have to pay EUR 250/400/600 in compensation if a flight was cancelled or delayed by 3 hours or more due to airlines’ fault. The Regulation applies to delays and cancellations caused by airline employees. The amount of compensation depends on the distance of the flight.

When are you not entitled to compensation in the event of a strike?

If the airline has no control over the strike, you are not eligible for compensation. For example:

  • Strikes by airport security staff
  • Strikes by baggage handlers
  • Strikes by air traffic controllers
  • Strikes by ground staff
  • Strikes by other airport workers
  • If a flight was delayed or cancelled outside Europe

These people are not under the control of the airline, so the strike is not the airline’s fault. In this case the airline does not have to pay compensation.

How much compensation are you entitled to in the event of a strike?

If your flight was cancelled or delayed by 3 hours or more due to airline employees’ strike, you can be entitled to EUR 250/400/600 in compensation.

The amount of compensation is determined by the distance of the flight:

  • EUR 250 for flights less than 1500 km
  • EUR 400 for flights between 1500 and 3500 km
  • EUR 600 for flights more than 3500 km

Right to care?

If your flight is delayed or cancelled, the airline must provide you:

  • Meals and refreshments
  • Access to communications including 2 telephone calls, e-mails, fax
  • If your evening flight is cancelled, you shall be offered hotel accommodation including transport between the airport and the hotel.

Reimbursement or re-routing, when and where?

If your flight is cancelled or delayed for more than 5 hours, you are entitled to a full refund of your ticket or a replacement flight.

If you are offered an alternative flight and placed in a lower class than the one you booked, you can get a reimbursement of the difference of the ticket prices.
