Instead of panicking let’s see what can be done at this type of events. There are two options: First - single booking. This is the simplest, you have one ticket with all your connecting flights on it.

The only most important thing is that all flights have to be operated by the same airline. In this case a sole airline’s responsibility to fly you from A to B and there’s also no need for you to collect your luggage at the layover airport the airline takes care of transferring that for you so you can pick them up at your final destination. What happens if you miss your connecting flight because of a problem with the first one? At this event the airline is responsible to book you on the next available flight.

During your wait food and beverage vouchers also telecommunication possibility is supposed to be provided. Should there be need for an overnight accomodation the airline will take care of that as well as the transportation to a nearby hotel. In this case you are responsible for choosing the adequate layover to have sufficient time to pick up and recheck in your luggage for the next flight. Should there be a missed connection in this case you won’t be eligible for any type of compensation mentioned above.

Please note that in case of budget airlines there are no such thing as connecting flights. All flights have to be booked independently and the airline is not responsible for missing the next one during your journey or for transferring your luggage from one to the other. In case of two separate tickets you can only be eligible for compensation if one of your flights is cancelled or more than 3 hours delayed and the amount of indemnity will be only for the affected flight not for your whole journey.

Compensation is only due if the reason for the delay or cancellation is not outside of the airline’s scope of operation (e.g. weather, strike or any other force majeure event). Should you be late for your flight don’t miss to notify the airline in time so there could be a possibility to buy a new ticket for the next one at a discounted price. If you have already checked in to the flight you’re about to miss there is no possibility to get the discount you will be marked as ’no show’ which can affect your return booking as well.

Trains are often delayed in Hungary, but it’s important to know the length of the delay. As in all major sectors, there is also an EU Regulation about rail passenger rights.

Under the Regulation, in the case of a cancellation or a delay of more than 60 minutes, passengers have the right to the reimbursement of the full cost of the ticket for the part of the journey not made, or continuation or re-routing under comparable transport conditions at the earliest opportunity or at a later date at the passengers’ convenience.

If passengers do not opt for reimbursement, they may claim a compensation for the delay. The Regulation sets the minimum compensation but railway undertakings can pay more compensation based on the transport contract. The rail passenger can claim minimum 25% of the ticket price for a delay of 60 to 119 minutes, and minimum 50% of the ticket price for a delay of 120 minutes or more. The passenger having a travel pass or season ticket can be entitled to compensation in accordance with the railway undertaking’s compensation arrangements. The compensation must be paid in money within one month after the submission of the request. Under the Regulation the compensation of the ticket price cannot be reduced by financial transactions costs such as fees, telephone costs or stamps. However, railway undertakings may introduce a minimum threshold under which payments for compensation will not be paid. This threshold shall not exceed EUR 4.

It is also important that the passenger is not entitled to compensation if he or she is informed of a delay before he buys a ticket, or if a delay due to continuation on a different service or re-routing remains below 60 minutes.

Although should the flight take off from an airport within the EU or the airline is registered in the EU (Community Carrier) it has to comply with these regulations and might have compensation obligations.

What are the details the passenger has to pay attention to? First and foremost, time! When have you been notified of the cancellation?

- if 14 days or earlier before your scheduled flight departure in this case you are not entitled to compensation. The airline is supposed to find you an alternative flight the closest to your original flight schedule. If you decline they will return your money for the plane ticket of that particular flight;

- if between 7 to 14 days before your scheduled flight departure you are not eligible for compensation if the airline offered re-routing, allowing you to depart no more than two hours before the scheduled time of departure and reach your final destination less than four hours after the scheduled time of arrival;

- if less than 7 days before your scheduled flight departure you are not eligible for compensation if the airline offered re-routing, allowing you to depart no more than one hour before the scheduled time of departure and to reach your final destination less than two hours after the scheduled time of arrival; In these events the airline is not obliged to compensate but to mitigate.

We can talk about destruction, loss or damage to baggage and baggage delays. The air carrier is responsible only for the checked-in baggage. Obviously, there are certain exceptions when the luggage is already damaged or overused.

The European Council mentions air carriers’ liability for passengers and their baggage in EC Regulation 2027/1997. Under the Regulation airlines must inform passengers of the provisions relating to their liability.

It is important to know that each airline has got very detailed rules and regulations regarding baggage problems. So, the rules of procedure are determined where and within what time the passenger have to report the problem and in what cases the airline is exempted from the payment and what the maximum amount is that the airline has to pay to the passengers etc. You can read it in their policy on their website. However, these rules must meet EC Regulation.

Under EC Regulation the air carrier’s liability for delayed or destroyed baggage is up to 1000 SDR. It’s about 1200 EUR.

It is important that the airlines can make a payment over that amount limit but they are not allowed to set a smaller amount limit.

You can make a claim not only against the air carrier but you can request a payment from your insurance company. Travel insurance policies always contain insurance events concerning lost and damaged luggage. It is essential that the insurers reimburse only under the terms and conditions in the contract. If there are certain exclusions in the contract, the insurer will not pay for them. It is also important that the insurers reimburse only those damages that have not been paid by the airlines. That’s why the insurers require all documents used during the procedure with the airline.

It is not a travel season now, however in the future, it is worth checking not only the terms and conditions of the airlines but buying a travel insurance in order to get a full reimbursement for our lost or damaged baggage.
